Business Real Property (BRP) within a SMSF is a hugely popular strategy and has a number of important SIS considerations that must be complied with at all times. This session will dive into a number of these issues and will be exploring:
- The BRP rules, including SMSFR 2009/1, and the interaction with the IHA rules.
- The connection between property-use and business, including what needs to be considered when changing a residential property to BRP and wanting to enter into a related party lease arrangement.
- Other common scenarios, including short-term accommodation (Airbnb), and the use of solar panels (existing or adding) on BRP.

There have been substantial changes to superannuation contributions over the past few years that have presented incredible opportunities for members to build their superannuation. However, there are many opportunities for members and advisers to inadvertently breach the caps when various areas are not considered. In this session, Jemma will outline some of the contribution issues to be aware of, and also the process where there is an excess and it needs to be dealt with (which is not as diabolical as it used to be). Items to be addressed include:
- Accidentally triggering a bring forward period where TSB and contribution history isn’t considered
- The change to the work test and what not meeting it means for contributions, especially with the procedures for deductibility.
- The process for dealing with an excess contribution – how to release excess amounts correctly.
